Which DC sports team has the Most Valuable Players? That would be DC United, a team being pushed out by the city. Help Keep United in DC so they can receive a fair deal on a lease and help develop a path to build a stadium with local investment and incentives.

I’m paying them eight fucking figures of money, but they don’t hold themselves accountable. Shit rolls up hill at my company. If someone anywhere screws up, then their boss and that person’s boss, etc. are all accountable, whether they knew of the problem or not. I am sick and fucking tired of people passing on the accountability. There are upsides and downsides to responsibility. If you can’t fucking handle the responsibility, then don’t fucking take the responsibility.

Weird things that annoy me — this isn’t journalism:
“The monster who killed himself and his two young sons in a Washington house fire…”

Yes, we can all agree that it was a horrible and tragic act, but that sort of editorializing actually detracts from the attempt to provide useful facts or contextual information. And perhaps the man was mentally ill or rendered incompetent by medication?

I wish there was a journalism standard in this country. There ought to be a certifying board, just like there are for doctors and lawyers, and a standard post-secondary curriculum.

Native itunes format isn’t mp3. It’s AAC (or m4a – it’s what the file extension is, I think).

I’ve had no problems with my Apple products playing with others. You can tell iTunes to rip into mp3 format, but native setting is AAC. My MacBook plays quite well with my Android phone—it (the Mac) is how I get all my ringtones and notification sounds onto it (my phone). Though, to be fair, I also have professional-grade audio-editing programs on my Mac that can create multiple file formats as well. The only format I don’t have that works for my Mac is FLAC format, but that’s just as easily remedied (I’d just have to download Songbird or something similar.

It’s just never been a huge issue for me. I have enough devices and programs that read every file format I use, that I’ve never really cared too much about converting to one single format or dismissing some device because it won’t accept some other format.

I use the data tracker on my phone (in General>Usage) to track my data for the month. I reset it every month so I can keep track of things. I got a text over the weekend saying I’ve used 65% (140MB) of data, but at that point the usage tracker on the phone said I had used ~90MB (20 sent, 70 received). I still didn’t go over for the billing period but I would have thought that it would be more accurate. I’ll see how it goes this month.

Help!!

Morning everyone. I need some car help/advice before I call the tow truck.
Driving home late last night from (where else?!) the hockey rink…the battery light goes on in my car, the ABS light, then the seatbelt light, then the brake light, followed by…the windshield wipers going on, the turn signals turning on and finally the lights dimming and going on and off with the car slowing down. I actually made it home and (as I predicted) when I turned off the car and then back on, it was dead. I’m assuming electrical, but I would really like some opinions before I ship the car off to the mechanic or the dealer. Thanks.

by Goaliemama on Feb 7, 2012 11:40 AM EST reply actions

Sounds like an Alternator belt or Alternator. It runs when the car is running to charge the battery. When the belt breaks or the Alternator dies, the car runs off the battery.

They ruled it very narrowly, it can potentially get punted to the SCOTUS but I don’t think Roberts will accept it because it’s such a state level thing. Nothing really intermingles at the federal level.

Except they’re arguing it based on the 14th Amendment, which is very much federal. I see it going.

by Aliceanna on Feb 7, 2012 2:00 PM EST up reply actions

True, but the reasoning behind it is as such: all orientations are equal under California law EXCEPT marriage, and Prop 8 specifically makes same-sex couples inferior to opposite-sex couples. It’s invoking it, but, they can’t push it up to the court. I’m sure some justices are itching to try it but nothing yet has shown that Roberts wants the court to be involved in a case like this.

Comrades, leave me here a little, while as yet 't is early morn:
Leave me here, and when you want me, sound upon the bugle-horn

by sydtron on Feb 7, 2012 2:07 PM EST up reply actions

and this:

“Although the Constitution permits communities to enact most laws they believe to be desirable, it requires that there be at least a legitimate reason for the passage of a law that treats different classes of people differently. There was no such reason that Proposition 8 could have been enacted,” the ruling states.

I don’t see the SCOTUS touching that with a 50’ pole

Comrades, leave me here a little, while as yet 't is early morn:
Leave me here, and when you want me, sound upon the bugle-horn

by sydtron on Feb 7, 2012 2:13 PM EST up reply actions

Oh, I am sure he wants no part of it, but I think the Prop 8 proponents are going to choose the SCOTUS route rather than the full 9th Circuit, figuring their chances are better with the Supremes (which they are).

Also, it’s not only Roberts’ decision. If 4 justices elect to hear the case, it gets heard. I can certainly see 4 of them deciding to hear this one.

by Aliceanna on Feb 7, 2012 2:17 PM EST up reply actions

Maybe, but that’s a lot. The court is packed with federalists but any interpretation of what the previous court decided will only apply to California. Not much sense in hearing it if they can’t exercise their philosophy.

Comrades, leave me here a little, while as yet 't is early morn:
Leave me here, and when you want me, sound upon the bugle-horn

by sydtron on Feb 7, 2012 2:19 PM EST up reply actions

And if they refuse to hear it, marriage equality remains law in California. Which is a win in my book. There are multiple issues at play, but whatever advances civil rights is all good, as far as I’m concerned.

At some point soon (i.e. the next few years), there will be a DOMA challenge, as that piece of crap legislation was blatantly unconstitutional from the moment it was drafted (and I believe Clinton knew that, and was intending that it eventually be challenged).

by Aliceanna on Feb 7, 2012 2:23 PM EST up reply actions

DOMA won’t get touched because it is an important fundraiser. States will continue legalizing marriage equality for the most part but there will be hold-outs.

Money is another good reason why the court won’t touch it: there’s not much money to be made on this case.

Comrades, leave me here a little, while as yet 't is early morn:
Leave me here, and when you want me, sound upon the bugle-horn

by sydtron on Feb 7, 2012 2:27 PM EST up reply actions

DOMA has to be touched at some point because DOMA affects legally married families in states with gay marriage. Basically, you can be legally married in California, but not be able to file jointly with the IRS as a married couple.

That seems like a clear violation of the 14th Amendment.

by Joran on Feb 7, 2012 2:29 PM EST up reply actions

DOMA makes money, and money makes things legal.

by sydtron on Feb 7, 2012 2:31 PM EST up reply actions

I’m not to that level of cynicism yet. I still think that the Supreme Court is mostly free of corruption or money.

At some point, DOMA will have to make its way up the chain of courts because there are people who are definitely being harmed and have standing.

by Joran on Feb 7, 2012 2:38 PM EST up reply actions

They still have ties to the legal community and political parties so they’re obligated to help them.

Comrades, leave me here a little, while as yet 't is early morn:

by sydtron on Feb 7, 2012 2:44 PM EST up reply actions

I’m not totally following this argument. You’re saying that because conservatives raise money on DOMA, that somehow conservative politicians will prevent DOMA from ever being heard in federal court?

There are multiple cases in all the federal courts, challenging DOMA on multiple grounds, and DOJ has ceased defending the law on the presumption that it is unconstitutional. I definitely see one of the multiple cases winding up in front of the Supremes, or standing with a lower court ruling of unconstitutionality, as most of the courts who have so far ruled on it have decided.

by Aliceanna on Feb 7, 2012 2:43 PM EST up reply actions

It’s like Roe v. Wade — that could probably be overturned in a heartbeat because it isn’t the most sound ruling (Casey v. Planned Parenthood is the anchor for choice) however, if it got moved there and one side “won” a new boogeyman would have to be invented for people to divide about. Same reason most of the Democratic party was bummed when Ted Stevens got the boot — he was a major fundraiser for the party because people rallied against him.

It’s why most issues like that, truly divisive stuff, won’t get past the state level. It’s easier to buy a politician in a state than it is in DC so you get people who can be legitimately crazy but easily fund* their re-elections. Eventually appellate courts step in as a relief valve to keep things from getting to the federal level and decided upon. That way politicians can fund their re-elections, the lobbyists can keep their jobs and the media can pull in ad revenue.

*pending on what happens with Citizens United, I suppose

Isn’t a challenge with abortion that it’s hard to get someone with standing to bring a lawsuit?

by Joran on Feb 7, 2012 2:58 PM EST up reply actions

Not really — Casey v Planned Parenthood was just about Pennsylvania laws. It was a bad decision because Roe v Wade is tenuous at best in its interpretation (at least, in my opinion and a lot of what I have read) of how the right to privacy interacts with choice but Casey v Planned Parenthood had some conservative heavyweights coming to bat for a lot of what Roe v Wade created.

Even finding someone who has gone through with the procedure shouldn’t be difficult. If you read around for stories people have of working at a facility, there are plenty of women who come in to have surgery who still remain ideologically opposed to abortion.

I guess it might make sense if I had that amount of bookin’ behind me but whenever I try to read the opinion of the court, it just comes off as saying women have the rights afforded to them because we just said so right here.

by sydtron on Feb 7, 2012 4:05 PM EST up reply actions

It didn’t really make sense to me at all.

Basically, the Supreme Court had derived together a patchwork of “right to privacy” from the Fourth and Fourteenth Amendments and parts of the Constitution, dating back to the 1800’s. My classmate had decided to pursue the origin of the right to privacy because it’s been used in multiple cases including Roe v. Wade.

It was my first glimpse into legal theory, graduate level work in history, and it made my head split.

No, both sides benefit from fundraising as long as it’s a topic. Dems get money arguing for it, too. (See abortion fundraising, you can probably throw DC representation in there as well, locally)

Perhaps. We see it differently.

I think that, as public opinion continues to swing toward equality (cool aggregation of poll results on the issue over the past several years), and equal rights begin to be denied to people in some states who are legally wed in other states, DOMA will most definitely be challenged.

by Aliceanna on Feb 7, 2012 2:31 PM EST up reply actions

We’re just shifting who to blame problems on, though. It’s a push toward egalitarianism but it’s glacially show and new victims show up all the time.

I really don’t understand how what you’re saying is a response to what I’m saying. Perhaps I’m being thick, or you’re talking about something else. “We” who? Who is “blaming”? What “problems” are you talking about?

by Aliceanna on Feb 7, 2012 4:43 PM EST up reply actions

Public in general — it’s a move towards egalitarianism, but migrant workers, Muslims, transgendered, transsexual and queer are still very much second class citizens. Society always needs someone to be afraid of, especially domestically. What little is gained by marriage equality is offset by using Muslim as a slur or transgenderism the latest sitcom fad.

Okay. While I don’t disagree with you, I fail to see how a sweeping generalization about the relative fuckedness of our society has any actual bearing on the discussion of one specific issue and what will happen with that one specific issue in the short-term future. One thing at a time, dude! ;)

by Aliceanna on Feb 7, 2012 5:15 PM EST up reply actions

They ruled it very narrowly, it can potentially get punted to the SCOTUS but I don’t think Roberts will accept it because it’s such a state level thing. Nothing really intermingles at the federal level.

i think you’re right. The Roberts court had a opportunity to get involved in marriage equality in DC and passed, noting that it did not have the jurisdiction to do so, seeing as this applied only to DC and DC law was quite clear that a human rights issues, which marriage equality and sexual orientation are defined as in DC, cannot be put to a popular vote.

I was devastated when Prop 8 passed. I volunteered and canvassed and took such pride in voting no. It was a failure of clarity on the part of the anti-prop 8 advocates, and some really bad internal politics, in my opinion, that allowed that piece of crap to pass in the first place.

by Aliceanna on Feb 7, 2012 2:48 PM EST up reply actions

What shocked the hell out of me was how much out of state money went into that travesty. Especially from the Mormon church.

by WordsOnIce on Feb 7, 2012 2:49 PM EST up reply actions

Yeah. Fucking Mormons launched a full-on assault. Good lord, the television advertising they paid for alone, with all the absurd lies about what Prop 8 would mean: teaching homosexuality in schools! Forcing clergy to marry teh homos! Everyone gets a same-sex spouse, whether they want one or not! Soon people will be able to marry their dogs!

by Aliceanna on Feb 7, 2012 2:57 PM EST up reply actions

No doubt. I’ve read they think it comes down to Justice Kennedy. I need to take a look at his voting record. However, it seems they’re going to allow marriages in California to go forward while awaiting the Supreme appeal.

An interesting element of this is that the guy who is arguing the unconstitutionality is former Solicitor General Ted Olson, who argued and won the Bush v. Gore 2000 election case for Bush (and was rewarded with the Solicitor Generalship for his trouble). Despite his W affiliation, he seems to actually believe in civil rights for all Americans, which I find remarkable.

by Aliceanna on Feb 7, 2012 2:00 PM EST up reply actions

Both sides from Bush v. Gore are arguing against it. David Boies teamed up with Ted Olson.

In Maryland, some of the sternest opposition to gay marriage is coming from people who normally vote Democratic. /sigh

It’s a microcosm for the country — the densely populated areas are more Democratic, and the sparsely populated areas are more Republican, and there are more people in the densely populated areas than in the sparsely populated areas, but there’s more land mass in the sparsely populated areas than in the densely populated areas

yeah, I remember seeing an electoral map where the vast majority of Maryland was red… Then realized that all the districts that were blue were where all the people lived.

Now, I’m in the same district as Allegany County… This should be fun.

I love it when the folks who make those maps adjust the size of jurisdictions for population so you get a much better sense on how votes are distributed. Doing it only by land size is disingenuous, imo.

Now, now, it serves a purpose. Tyranny of the majority and all that. I think the whole thing could be fixed if we kept the electoral college but every state’s electors were assigned in proportion with the vote instead of winner-take-all. Two (?) states do it that way now, and I cannot fathom why it’s allowed to be nonuniform or why the other states haven’t all followed suit. But then, I can’t see why elections aren’t held to a certain national standard.

Well, in that scenario it’s just a popular vote but you remove some trailing zeroes, so it may be imprecise but certainly a step in the right direction.

Eat, drink, and be merry! And then drink some more.

by SmallZ827 on Feb 7, 2012 3:41 PM EST up reply actions

There’s some movement by states to do it by popular vote. Maryland passed a law that they’d apportion their electors by popular vote if enough states signed on.

by Joran on Feb 7, 2012 3:45 PM EST up reply actions

It’s fairly progressive — apart from MD-1, the state leans heavily toward liberal causes. A lot of it has to do with how ingrained biosciences and bureaucratic function is in the state, of course. Marriage equality would have happened here years back had the congress not properly insulated it from the Catholic church which is still fairly strong here. The new law is much more church friendly so it’ll move through with only a token amount of dissent. Churches here aren’t as organized as elsewhere apart from the Catholics so it was just about appeasing them.

by Aliceanna on Feb 7, 2012 2:46 PM EST up reply actions

it was a Truth in Lending Act case.

I absolutely went to the hearing, I lost badly (8-1, only Scalia was on my side) but the reality was I won even though I lost the Supreme Court hearing.

by Beakers Lab on Feb 7, 2012 2:55 PM EST up reply actions

That’s an interesting position to be in. I wasn’t aware that Thomas was ever allowed to dissent from Scalia! I thought his butt-boy agreement was pretty clear on those terms. ;)
